These Website Terms of Use govern your access to theconversionberg.com and related public pages operated by The Conversion Berg. By using the site you agree to these terms. If you do not agree, do not use the site. Information on the site is general and is not a binding offer, quote, or professional guarantee. Paid services start only when a proposal, statement of work, or other agreement is signed (including by electronic signature) and any stated conditions are met.
Who may use the site
The site is intended for people acting in a business or professional capacity who are old enough to form a contract. You must provide accurate information in forms and not impersonate another person or organisation. If you use the site on behalf of a company, you confirm you have authority to bind that company to these terms for site use. Portal, billing, and signing surfaces have additional terms linked from those pages.
Acceptable use
You must not misuse the site. That includes probing or attacking security, introducing malware, scraping at a volume that degrades the service, submitting unlawful or infringing content, harvesting other users’ data, bypassing rate limits or CAPTCHA, or using the site to send spam. You must not rely on case studies, portfolio pieces, or illustrative metrics as a promise that the same result will occur for you. Outcomes depend on your market, budget, approvals, and third-party platforms.
Intellectual property
The Conversion Berg and its licensors own the site design, copy, logos, and software except where a page says otherwise. You may view and print pages for your own internal evaluation of our services. You may not copy the site for a competing offering, remove notices, or use our marks in a way that suggests sponsorship without written permission. Client work shown in the portfolio remains subject to the client’s brand rights; it is shown as an example of delivery, not as a licence for you to reuse those assets.
Third-party platforms and links
The site may link to booking tools, payment pages, social networks, or documentation hosted elsewhere. Those services have their own terms and privacy notices. Outages, policy changes, or account suspensions on advertising, hosting, analytics, or commerce platforms can affect timelines and are outside our direct control. You remain responsible for accounts, credentials, ad spend, and content you control on those platforms.
Enquiries, proposals, and paid work
Submitting a form or booking a call does not create a delivery contract. We may decline work that is unlawful, that we cannot resource, or that falls outside our services. A signed order controls scope, fees, timelines, and client responsibilities. If there is a conflict between marketing copy on this site and a signed order, the signed order prevails for that engagement.
Payments, refunds and cancellation
All fees are final and non-refundable once payment has been received. For any monthly or recurring service, the customer must give cancellation notice by email to the address stated in the proposal, invoice or agreement at least thirty (30) full calendar days before the requested cancellation date. Fees remain payable throughout the notice period and no pro-rata refund is provided. This rule does not exclude any mandatory statutory right, payment-scheme guarantee, or written remedy expressly agreed for non-delivery or a material service failure. The Refund, Cancellation and Dispute Policy and the Payment and Direct Debit Terms give more detail.
Liability
The site is provided as a public information and enquiry channel. To the fullest extent permitted by law we exclude liability for loss of profit, loss of business, loss of data, or indirect or consequential loss arising from use of the public site. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. For paid services, liability is as stated in the signed agreement.
Availability and changes
We may change, suspend, or withdraw pages for maintenance, security, or business reasons. We try to keep the site available but do not warrant uninterrupted access. We may update these terms by publishing a new version on this page. Continued use after the effective date of a new version is acceptance of that version for ongoing site use.
User content in forms
Anything you submit through a form must be accurate and lawful. You grant us a licence to use that content to respond to the enquiry and to perform any later contract. You must not submit confidential information of a third party unless you have the right to do so. We may refuse or delete submissions that appear abusive or illegal.
Privacy
How we handle personal data is described in the Privacy Notice, Cookie Policy, and Marketing and Consent Notice. Electronic signing is described in the Electronic Signature Policy. Portal use is described in the Client Portal Terms.
Changes to this document
We may update this document when our services, tools, or legal duties change. Material changes are issued as a new version with an effective date. The version shown at the foot of this page is the current public text. A signed proposal, statement of work, or agreement remains governed by the version incorporated into that order unless the parties lawfully agree otherwise. Minor corrections that do not change your rights may be published without a separate email notice.
Governing framework
Contracts use the law of England and Wales as the primary governing framework unless the signed order expressly states another governing law. Mandatory local protections continue to apply where they cannot lawfully be excluded, including protections under UK GDPR, the Data Protection Act 2018, PECR, and, where a Canadian resident is involved, PIPEDA, CASL, and applicable provincial privacy law.
